The OECD Due Diligence Guidance for Responsible AI: Accountability Has Entered the Chat

The OECD’s 2026 Due Diligence Guidance for Responsible AI is not another set of aspirational principles. It is a governance blueprint.

For the past few years, organisations have been navigating a crowded landscape of AI frameworks, the EU AI Act, NIST AI RMF, national guidance documents, industry codes of conduct. Many of these focus on risk management. Fewer address corporate responsibility in a structured and enforceable way.

The OECD Guidance does.

It takes the language of Responsible Business Conduct and applies it directly to artificial intelligence. It makes one thing clear: AI governance is not a technical side project. It is a core enterprise obligation.

AI Governance Must Be Embedded, Not Bolted On

The Guidance sets out a six-step due diligence framework: embed governance into management systems, identify and assess adverse impacts, cease or mitigate harm, track implementation, communicate transparently, and cooperate in remediation when appropriate.

On paper, that sounds straightforward.

In practice, this means AI governance cannot sit in a PowerPoint deck or within a single innovation team. It must be integrated into enterprise risk management, procurement, compliance, and executive oversight structures. AI systems must be visible. Ownership must be clear. Decisions must be documented. Controls must be auditable.

If AI is influencing business outcomes, then AI risk must sit within the same governance architecture as financial, operational, and regulatory risk. Anything less is unhelpful.

Responsibility Extends Across the Value Chain

One of the most important contributions of the Guidance is its clarification of involvement. It distinguishes between harm an organisation has caused, harm it has contributed to, and harm to which it is directly linked through business relationships.

That distinction matters.

Most organisations today rely heavily on third-party models, SaaS platforms, embedded AI features, and vendor-supplied tools. If a supplier introduces AI functionality in a software update and your organisation deploys it without understanding the implications, you do not escape responsibility simply because you did not build the model yourself.

Due diligence extends across the value chain.

This means vendor assessments must evolve. Contractual clauses must anticipate AI functionality. Release notes must be scrutinised. Embedded AI must be identified, not discovered after an incident.

The era of “we didn’t build it” as a defence is over.

Stakeholder Engagement Is Structural, Not Cosmetic

The Guidance places strong emphasis on meaningful stakeholder engagement, particularly with groups who may be vulnerable to adverse impacts. Engagement must be two-way, conducted in good faith, and responsive to feedback.

This is not a communications strategy.

It requires organisations to consider who might be affected by an AI deployment, engage them before major decisions are made, and document how that engagement influenced outcomes. If a system affects students, patients, employees, customers, or communities, their perspectives cannot be an afterthought.

Responsible AI without stakeholder engagement is incomplete by design.

Prevention Is Not Enough. Remediation Must Be Planned.

Many AI governance programs focus heavily on prevention. They assess risk, define controls, and move forward.

The OECD goes further.

Where an organisation has caused or contributed to harm, it is expected to provide or cooperate in remediation. That means incident response cannot be improvised. It must be designed in advance.

Organisations need predefined escalation pathways, suspension mechanisms, and clear authority to pause or retire systems if required. If you cannot confidently stop a model tomorrow, you do not truly control it.

Remediation is not a public relations exercise. It is a governance obligation.

Interoperability Is Not Optional

The Guidance maps directly to global frameworks such as the EU AI Act, NIST AI RMF, and others. This is significant because it signals that AI governance must become integrated, structured, and cross-jurisdictionally coherent. Patchwork compliance and siloed approaches will not scale.

Organisations operating across jurisdictions cannot afford to run separate governance programs for each regulatory regime. The expectation is convergence. Governance artefacts, documentation, monitoring processes, and reporting mechanisms must be interoperable.

This is not about ticking boxes in multiple frameworks. It is about building a system that aligns with all of them by design.

What This Means for Organisations

The implications are practical and immediate.

Organisations need a central inventory of AI systems. They need lifecycle-aligned risk assessments that consider involvement and business relationships. They need documentation that demonstrates how impacts were identified, mitigated, and tracked. They need transparency mechanisms that inform stakeholders without compromising competitive position. They need monitoring capabilities that extend beyond deployment into ongoing operation.

And they need remediation pathways that are real, not theoretical.

Advisory reports and policy statements will not meet this bar.

Governance must become operational.
